Tanya Zuckerbrot, Founder of F-Factor, Resolves Lawsuit Against Emily Gellis After Six Years of Litigation

Settlement Includes $240,000 Payment and Public Video Apology to Remain Pinned on Gellis' Social Media Profile for Three and a Half Years
NEW YORK, Oct. 5, 2026 /PRNewswire/ -- Tanya Zuckerbrot, MS, RD, founder of F-Factor, has resolved her defamation and cyberstalking lawsuit against fashion influencer Emily Gellis after six years of litigation. As part of the settlement, Gellis is publishing a public video apology on her Instagram account, acknowledging that the allegations she promoted were not supported by verified evidence.
"I spent 25 years building my career and F-Factor, only to watch a smear campaign built on lies destroy my company within months," said Zuckerbrot. "While I was fighting to save everything I had worked for, I was also enduring relentless cyberstalking and harassment that reached into my home and my family's life. An apology cannot undo that damage or give us back those years, but this settlement represents accountability. Now, I'm focused on rebuilding F-Factor, returning to the work I love and reclaiming the future I worked so hard to create."
Under the settlement, Gellis agreed to pay Zuckerbrot $240,000 in monthly installments of $500 over 40 years. The payment represents reimbursement for the costs of trauma treatment Zuckerbrot underwent as a result of the campaign. The settlement also requires Gellis to publish a video apology on her social media and keep it pinned to the top of her profile for three and a half years, ensuring it remains prominently visible to visitors.
The lawsuit arose from Gellis's social media campaign against Zuckerbrot and F-Factor. The lawsuit alleged Gellis used her platforms to amplify anonymous allegations to a large online audience, including claims of arsenic contamination, serious health harms and personal misconduct. In her public apology, Gellis acknowledged that the allegations she shared were based on anonymous submissions rather than verified medical, scientific or expert analysis.
According to court records, Gellis posted more than 4,500 Instagram stories about F-Factor in just 75 days. The total number of videos and posts about her over the following years exceeded 50,000. As the posts escalated, Gellis shifted from product allegations to deeply personal attacks involving false accusations of drug use, tax evasion and criminal activity.
As the case stated, F-Factor products were co-manufactured in a pharmaceutical–grade facility and tested for microbiological safety, heavy metals and label accuracy. Certificates of analysis and a toxicology report supported their safety. Despite receiving this documentation, Gellis continued to promote allegations of contamination and claimed "tens of thousands" of victims, figures she now publicly acknowledges were inaccurate and false. Her campaign didn't stop with social media, she also contacted retailers, brand partners, celebrity clients and ambassadors to coerce them to cut ties with Zuckerbrot and F-Factor.
Zuckerbrot is preparing to relaunch F-Factor in 2027, returning to the nutrition education and fiber-focused approach she has championed for more than two decades.
