Istana Negara: No ambiguity in King’s conditional pardon order for ex-PM Najib

KUCHING, Nov 7: Istana Negara has reaffirmed that the conditional pardon order granted to former prime minister Datuk Seri Najib Tun Razak, allowing him to serve his sentence under house arrest, is clear, unambiguous, and must be respected.

In a statement issued today, Yang di-Pertuan Agong Sultan Ibrahim stressed that the conditional pardon granted to the former prime minister must be respected and implemented, following the Attorney-General’s Chambers’ (AGC) recommendation to defer his house arrest pending a review.

“There should be no confusion or differing interpretations, nor should it give rise to prolonged uncertainty regarding the implementation of the decision that has been granted.”

It added that the power to grant pardons is a royal prerogative vested under Article 42 of the Federal Constitution, and that this power must be exercised in accordance with the position of the constitutional monarchy and the principles of the rule of law.

“Given that all the conditions stipulated in the conditional pardon order have been fulfilled, any attempt to question the order would amount to moving towards defying the decree of His Majesty the King,” said the statement.

On Nov 6, the AGC called for the implementation of house arrest for Najib to be temporarily deferred pending further legal scrutiny and clarification of the Conditional Pardon Order and the implications of a subsequent Order of Discharge.

The AGC said Najib should remain at his current place of detention throughout the deferment period, subject to the powers and directions of the relevant authorities.

This came after Najib’s RM50 million fine has been paid, allowing the former prime minister to serve the remainder of his prison sentence under house arrest until Aug 23, 2028.

The fine was paid via a fundraising campaign raised by the United Malays National Organisation (Umno). — DayakDaily
